Welcome to LeafRootSeed ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at leafrootseed.sbs (the "Service") operated by LeafRootSeed.

By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Overview

LeafRootSeed offers the following premium yacht charter services:

• Daily yacht rentals
• Sunset cruises
• Corporate retreats
• Private functions
• Extended charters over multiple days

We maintain the right to change or halt services based on availability and weather conditions.

3. Booking and Reservations

3.1 Booking Process

For a charter reservation, you are required to:

• Confirm you are at least 18 years of age
• Supply true and complete details
• Remit a deposit according to your booking confirmation
• Accept these Terms & Conditions

3.2 Confirmation

A booking is regarded as confirmed once payment is received alongside our written confirmation. We may decline service provision at our sole discretion.

3.3 Availability

Charter availability is contingent upon both vessel availability and favorable weather conditions. We shall try to accommodate your requested dates and times.

4. Payment Terms

4.1 Pricing

Prices are provided in € and cover applicable taxes unless stated otherwise. Prices are susceptible to alterations without prior notification.

4.2 Payment Schedule

• Initial Deposit: A payment of 50% of the full charter fee is due at time of booking
• Remaining Balance: Payable 48 hours before the charter's commencement
• Additional Costs (if any): Payable after the charter’s conclusion

4.3 Payment Methods

We accept a variety of payment methods including major credit cards, electronic bank transfers, and bank-issued checks, using secure encryption for processing.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• With more than 72 hours before departure: An almost full refund subject to processing fees
• Between 24 to 72 hours prior to departure: A refund of 50%
• With less than 24 hours to departure: Non-refundable

5.2 Weather Cancellations

In cases of unsafe weather as decided by our captain, options include:

• Rescheduling your charter to another accessible date at no additional cost
• Issuing a complete refund if rescheduling proves unfeasible

5.3 Mechanical Issues

Should there be mechanical issues with the assigned vessel, we will strive to provide an akin alternative. If no alternative exists, a complete refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

All guests are to:

• Adhere to all instructions from the crew
• Utilize provided safety gear when required
• Inform of any health conditions that could affect their safety
• Stay within designated areas on the vessel

6.2 Prohibited Items

The items below are not allowed on board:

• Glass containers
• Illegal drugs
• Weapons, including firearms
• Excess food and beverages (beyond reasonable amounts)
• Pets without prior permission

6.3 Conduct

Passenger behavior should be respectful at all times. We reserve the option to end a charter early, without a refund, if a passenger’s conduct endangers safety or disrupts others’ experience.

7. Liability and Insurance

7.1 Our Liability

We limit our accountability to the charter cost paid by you. We disclaim responsibility for:

• Injuries arising from guest negligence
• Loss or damage to personal belongings
• Indirect, consequential, or exemplary damages
• Delays due to weather or unforeseen situations beyond our control

7.2 Insurance Coverage

Our vessels and operations are covered by comprehensive marine insurance. Passengers should ensure they have their own travel and personal insurance.

7.3 Assumption of Risk

Engaging in our charter activities implies acknowledgment of inherent maritime risks, accepting personal responsibility for safety and health.

8. Modifications and Itinerary Changes

We retain the right to alter itineraries, routes, or schedules because of weather conditions, safety needs, or operational requirements. We will endeavor to provide a comparable alternate experience wherever feasible.

9. Force Majeure

We shall not be considered liable for delays, cancellations, or changes resulting from factors outside our control. These include but are not restricted to:

• Intense weather conditions
• Natural catastrophes

• Vessel malfunction

10. Privacy and Data Protection

Your private details are managed in line with our Privacy Policy. By engaging our services, you consent to our data collection and use as specified in the Privacy Policy.
